How Did Carey Birmingham Only Get 10 Years In Prison?

Interestingly, the jury here was all-female.

You may have heard of this one — it’s from the Houston era. (I believe it was in Spring.) In December 2021, this guy Carey Birmingham believed his wife (Patricia) was having an affair, and he confronted her in the driveway, while wearing a robe and his wee-wee was hanging out. Patricia, oddly, was filming the entire thing, and there are various exchanges between them where she says “You don’t want this to be on film, do you?” and he says, “I’ll pull it. I am man enough to pull it.” Eventually he did pull it, shooting her three times in the face and killing her.

A few years later, his case went to trial. It was not a death penalty or even life in prison thing — the prosecutor team was asking for 20 years, which I believe was 20 because he admitted to it. Instead, he got 10 years, with parole eligibility in five years, which shocked some people (including Patricia’s family). What is perhaps more unique is that the seated jury in Harris County was all-female, which is incredibly rare but does happen.
